“Advance Care Planning” – Practical and Legal Considerations

Advance Care Planning is about consent for future health care treatment and personal choice. We want to encourage the conversations amongst our patients and their families, as well their health care providers and significant others who also have a role in supporting appropriate planning for future care. We want to ensure that British Columbians are aware of all options available to them so they feel empowered to make their own decisions. Presentation will focus on how Advance Care Plans function when consent for health care treatment is required the adult no longer has capacity to speak for oneself.
SPEAKERS
Judy Nicol is a Regional Practice Leader with the Interior Health (IH) Professional Practice Office with a focus on clinical ethics. Her clinical background is Social Work and has worked in acute, residential and community health care settings prior to moving into positions within the realm of quality, risk management and professional practice. In 2011 she was the IH Lead for the Provincial Advance Care Planning Initiative, and over the past couple of years has focused on the development and implementation of Medical Orders for Scope of Treatment (MOST) and Advance Care Planning Policy across all acute, residential, community health care settings, including primary physicians.
Gerrit Clements, JD, is a practising health lawyer and teacher.He is an adjunct professor at the University of Victoria and at the university of northern British Columbia where he teaches health care law, and ethics and law in nursing, respectively. He also teaches health law at the University of the Fraser Valley and at Vancouver Community College.
He has given legal advice to health care providers and governments since 1974. From 1981 to 2007 he was senior legal advisor to the ministry of health. In that capacity he gave legal advice to the B.C. government with respect to the mental health act, including all court challenges and significant amendments. He was responsible for all editions of the Guide to the Mental Health Act from 1996 to 2005.Gerrit was involved in the planning and writing of all B.C. legislation on consent, substitute decision-making, advance care planning and adult guardianship over 28 years.
